What these terms cover

These terms govern use of the website. They are not the service agreement. Say so in the first sentence, and point at the service agreement or work-order terms for anything about the work itself.

Worth checking with counsel: the site now takes service requests, so the boundary between website terms and service terms matters more than it did on a brochure site.

Service requests submitted here

A submitted request is a request, not a confirmed appointment or a binding quote. Dispatch confirms scheduling separately. Emergency work outside business hours is billed at after-hours and overtime rates. That sentence appears on the request form and the location pages too, and all three should match.

Accuracy of information

Equipment listings, parts availability, coverage areas and hours are provided in good faith and can change. Nothing on the site is an offer to sell at a stated price.

Invoices and payments

Online payment runs through the customer portal and requires an account. Fortis processes the transaction and its terms apply to the payment itself. Disputes follow the process on the invoice.

Trademarks and content

Site content and the CONES marks belong to CONES Solutions. Manufacturer names and marks belong to their owners and appear here to identify equipment we service and sell, which is nominative use and worth stating.

Disclaimers and limitation of liability

Standard language, drafted by counsel, not by design. Carry the existing text across rather than rewriting it.

Governing law

Illinois, with venue named. Confirm the existing page says this before carrying it forward.
